Would it be prudent to wait?

for the suspect in a murder to be formally charged with the crime before filing a law suit against a state, county, and local office? i believe they are aware of their misconduct and negligence and haven't after 3 years charged said party knowing, through expressed conversation, that they are the guilty parties
